Introduction
Please read these terms of sale carefully before accessing this website. By proceeding with use of this website you will be understood to have read and agreed to the following terms of sale.

​Interpretation
In these terms of sale, “we” means Annaloucah (and “us” and “our” will be construed accordingly); and “you” means our customer or potential customer for products (and “your” will be construed accordingly).

Trade Marks
Annaloucah is the operator and owner of annaloucah.com. All products – names, designs and descriptions remain property of Annaloucah as do all logo’s trademarks and company names. No additional permissions are given by us in respect of the use of any such photographs, brand names, product names or titles. Any use of such may constitute an infringement of the owners’ rights.

Owner risk
The products will be considered your full responsibility from the time of delivery. Ownership of the products will only pass to you upon delivery of the products. We will be entitled to recover payment for the products even where ownership has not passed to you in the case of special commissions.

Delivery policy
We will make every effort to deliver products within 14 days of the date of our order confirmation and receipt of full payment. If this timeframe causes you a difficulty, please contact Anna directly to discuss other delivery options. However, due to the bespoke studio nature of our business we cannot guarantee delivery by the relevant date. This will be only in exceptional circumstances and the purchaser will be informed and kept up to date of any such unlikely eventuality.

Price and payment
Prices for products are quoted on our website. The website contains a large number of products and it is always possible that some of the prices on the website may be incorrect. We will verify prices as part of our sale procedures so that a product’s correct price will be stated when you pay for the product.

In addition to the price of the products, you may have to pay a delivery charge, which will be as stated when you confirm payment for the product.​

Please note, duties and taxes incurred at the point of entry to the destination country are the responsibility of the customer. Please contact info@annaloucah.com to discuss such additional costs.

Payment must be made upon the submission of your order. We will withhold the products and not issue any contract between us until the price is received from you in full in cleared funds. The prices on the website include all value added taxes.

Payment for all products must be made by credit or debit card.

Prices for products are liable to change at any time. Changes will not affect contracts which have come into force.

Orders, acceptance and returns
No contract will come into force between you and us unless and until we accept your order in accordance with the procedure detailed below.

​Before you place your order, you will have the opportunity to identify whether you have made any input errors by checking your shopping cart before proceeding to confirm payment. You may correct those errors before placing your order by removing or updating quantities.

​We reserve the right to refuse any order at any time which is placed with us by an individual, a group of individuals, a member of the same household of said individuals, user of the same credit card or payment method.

​You may cancel your purchase of product or products at any time within 48 hours of making your purchase receiving a full refund as long as your purchase has not been dispatched or the goods supplied have been made to your specifications or personalised.

​If you cancel a contract on this basis, you must inform us in writing. Any returns after the period stated above will be at the discretion of Annaloucah Fine Jewellery. Annaloucah retains the right to determine the length of time required to issue a full refund.

​Items that are custom made or to special order are non-returnable nor refundable unless deemed faulty due to a manufacturing problem. In such cases a repair or replacement item will be offered free of charge.

​Products already dispatched can be returned by you within a 7 day cooling off period. All goods must be returned in their original condition including packaging to Annaloucah Fine Jewellery. Any signs of wear will be interpreted as a right to refuse return.  

​In the case of such return no refund can be issued however a credit note for the full value will be issued (including the cost of sending the products to you). However, you will be responsible for paying the cost of returning the product to us.

​If you cancel a contract on this basis we will not issue the credit note to you until we have received the goods back in accordance with this clause. 

​You will be responsible for the item until it reaches us and we therefore recommend that a guaranteed and insured return service be used requiring a signature as proof of delivery.

Should an item display a manufacturing fault it can be returned up to a period of 3 months after delivery. All items returned as faulty will inspected and repaired where possible or exchanged for the same product. Any damage deemed to be a result of normal wear and tear will not be accepted as faulty. If a faulty item cannot be repaired or the same product is not available, you will be entitled to a full refund. Annaloucah retains the right determine the length of time over which the refund is issued.

Items that are not faulty but deemed broken due to wear and tear will be repaired for a charge dependent upon the amount of damage. No refund or credit note will be issued under such circumstances. Returns and return shipping cost remain the responsibility of the customer.

By using this website and placing an order with Annaloucah Fine Jewellery you are in turn guaranteeing to us that

  1. the information provided in your order is accurate and complete;
  2. you are able to accept delivery of the products;
  3. you are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these terms of sale

Specially commissioned pieces

A minimum value of £1000 applies to all commissioned pieces unless otherwise agreed.

Commissions can be arranged either in person or via alternative methods of communication.

​The commission process will begin with a detailed discussion of your specific requirements followed by – where necessary – a selection of designs being presented for clients’ selection. This work will be given as a gesture of goodwill with the understanding that the intention to proceed with the commission is genuine and sincere.  Only once the commission is agreed and a design chosen will there be a requirement for a deposit to be paid. The deposit due will be 50% of the total cost of the project unless agreed previously. This deposit is none refundable once work of any kind has been commenced on your piece.

​Any additional design work requested and deemed to be beyond reasonable stated efforts may be charged for at the discretion of Annaloucah.  

​All designs remain the property of Annaloucah.

​Whilst all care and attention will be taken to create a piece of jewellery which is accurate and entirely representative of initial agreed design, occasionally slight modifications will need to be made due to unforeseen circumstances whilst creating your one of a kind piece of specially commissioned piece of jewellery. You will be kept updated via email under such circumstances.

​By entering into a special commission order with Annaloucah you agree that no refund can be issued under any circumstance after work of any kind has been commenced on your piece however a credit note may be issued at the discretion of Annaloucah. In the unlikely event of such a situation highest priority will be placed on creating a mutually agreeable arrangement.

​Commissioned pieces or pieces that have been modified in anyway are not eligible for return once ownership has been taken unless faulty, damaged or incorrectly described. In such cases a credit note will be issued.

​The estimated length of time taken to complete a commission is 5 weeks from date of deposit being received. Shorter lead times may be arranged with specific arrangement. Please contact Anna directly to discuss in more detail. Whilst all efforts will be made to ensure that the agreed delivery date is met, Annaloucah reserves the right to request an extension due to unforeseen circumstances.

Remodel and repair

Annaloucah accepts no responsibility for the quality of items left in her care for remodelling and reserves the right to stop the process at any time if materials are not of expected / described quality or standard.

In such cases any deposit paid will be none refundable.

Annaloucah offers no formal identification on quality of customers own materials but can seek formal identification at clients own expense.

All due care and attention will be paid, however, Annloucah accepts no responsibility for damage / breakage of gemstones taken from customers own jewellery.

Annaloucah reserves the right to increase any originally quoted price if, once work has commenced, it becomes apparent that the job is more complex than first estimated due to quality of customers own materials or original workmanship.

Only metals that bare a full UK hallmark will be considered for remodelling

Gift Cards

More than one gift card can be used per purchase

Gift card and purchase values can be increased by any amount, however, no financial remuneration can be offered on a card’s value.

Gift cards can be purchased to an exact and specific amount upon discussion however the full value of the gift card must be used in one transaction.

Annaloucah takes no responsibility for lost or stolen gift cards.

General terms 
Terms laid out on this page are intended as clarification, security and benefit of both customer and seller. These terms of sale supersede all previous agreements and understandings between the parties in relation to the purchase of products from our website; and each party acknowledges that no representations not expressly contained in these terms of sale have been made by or on behalf of the other party in relation to the purchase of products from our website.

Images of products on our website are for illustrative purposes only; actual products may differ slightly.

We will treat all personal information that we collect in connection with your order in strictest confidence and will never share any contact or order details with any outside party. By ordering, enquiring or contacting us in anyway Annaloucah reserves the right to add your email address to a mailing list specific and exclusive to Annaloucah Fine Jewellery. Any future correspondence made through this method will be no more frequent than four times a year and the option to opt out will be offered on every such communication.

We may revise these terms of sale from time to time, but such revisions will not affect the terms of any contracts into which we have entered with you at the time of purchase.

If any provision of these terms of sale is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect, and such invalid or unenforceable provisions or portion thereof will be deemed omitted.

You may not assign charge, sub-contract or otherwise transfer any of your rights or obligations arising under these terms of sale. Any attempt by you to do so will be null and void. We may assign, charge, sub-contract or otherwise transfer any of our rights, obligations or manufacturing process arising under these terms of sale, at any time, providing such action does not reduce the guarantees benefiting you under these terms of sale or in any way compromise the quality of your purchase. Such actions are considered routine practice within the UK jewellery industry and need not be disclosed at time of sale.

Each contract under these terms of sale is made for the benefit and security of all relevant parties and are not intended to benefit or compromise any persons involved in any transaction. The right of the parties to terminate, rescind, or agree any amendment, variation, waiver or settlement under such contracts is not subject to the consent of any person who is not a party to the relevant contract.

Annaloucah reserves the right to amend, expand or delete any of the above terms of sale at any time however such alterations will not affect the rights specified in contracts at the time of sale. These terms of sale are eligible for governance in accordance with English law, and the courts of England and Wales will have non-exclusive jurisdiction to adjudicate any dispute arising from a suspected breach of said terms.
